Privacy Policy

Please read the following Privacy Policy (“PP,” “Policy” or “Agreement”) carefully before viewing or using any services, features, content or applications offered by Switch Maven Pty Ltd, (“SM,” “we,” “us” or “our”) via switchmaven.com or their training programs, (“Site” and together as “Services”).

  1. Preamble and General Principles

    1. Switch Maven Pty Ltd. (“SM”) has created this privacy statement in order to demonstrate our respect for yours and our firm commitment to, privacy. This policy describes our practices on switchmaven.com (the “Site”) where it is posted. It also applies to SMS messages, cloud storage, and emails.

      The following information is designed to help you understand how we collect, use, disseminate and safeguard the information you provide to us while accessing and using our Site. You agree to the terms in this policy when you use this Site. If you do not agree with our information practices, please do not access or use our Site.

    2. This Policy does not apply to our use of employee information. It also does not apply to information we collect from you offline.

    3. The primary and intended purpose of the Site is specifically to inform prospective students about who we are, what we offer, and to obtain only as much information as is needed to follow-up with Visitors & those who choose to submit information through the Site (“Applicants”, collectively “your,” “yours,” “User” or “Users”). In the future we will allow Users to pay for courses and materials via the Site.

  2. Revisions to the Policy

    This Policy may change from time to time, without notice other than appearing on a SM Site. SM reserves the right to revise, amend, or modify this Policy and our other policies and agreement at any time and in any manner. Your continued use of the Site constitutes your agreement to all revisions of the Policy. Users should note the date of last revision to this Policy, which appears at the top of this Policy. This Policy was last revised on [insert date].

    If the “last modified” date remains unchanged after a User has clicked the “refresh” button on his/her browser, the User may presume that no changes have been made since the last reading of the Policy. A changed “last modified” date indicates that this Policy has been updated or edited, and the updated or edited version supersedes any prior versions immediately upon posting.

  3. Types of Data.

    “Personal Data” means data that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data.

    “Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. We collect Personal Data and Anonymous Data.

    1. General Site Purpose, Data & Information Collection.

      While the Site is designed so that Users may generally browse it without providing any Personal Data, certain areas of the Sites, for example, may collect your name and email address. We may also collect your street address, ask you about phone number and ask about your interests or other similarly general questions. SM uses your Personal Data for the purposes it was submitted by you to SM and for SM to send you news, publications and invitations that may be of interest to you.

      Other general uses of the Personal Data you submit to us is used to respond to requests that you make.

      For example, ways we use your Personal Data include but may not be limited to:

      1. Improve Customer Service: Information Users provide helps us respond to customer service requests and support needs more efficiently.

      2. Personalize User Experience: We may use in the aggregate to understand how our Users as a group use the services and resources on our Site and in our courses.

      3. Improve Our Site: We may use feedback you provide to improve our content, products, services, etc.

      4. To Process Payments: We may use the information Users provide about themselves when making a payment only to provide the content and service for that order. We do not share this information with outside parties except to the extent necessary to process and provide the service.

      5. To Run a Promotion, Contest, Survey or Other Feature: To send Users information they agreed to receive about topics we think will be of interest to them.

      6. Periodic Emails: We may use the email address Users provide to send the User information and updates pertaining to their payment(s), content, product, services, inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include our news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, they may do so through the links within the email of by contacting us via our Site and allowing us a reasonable amount of time, according to the laws where the User is located, to comply with the unsubscribe and to scrub the User from our mailing list.

      If you use our Site, we may collect information about the browser you are using. Our web server may store your IP address and domain. We might track the pages you visit. We might look at what site you came from, or what site you visit when you leave us. For example, we collect this information using tracking tools described in this Policy. To control those tools, please read the Your Choices section.

    2. Disclosure of Your Personal Data.

      We disclose your Personal Data as described below and as described elsewhere in this Policy. We may also disclose personal information about Users, for any reason if, in our sole discretion, we believe that it is reasonable to do so, including:

      1. As part of a specific program, feature, content, etc. for which you have the ability to opt-in or opt-out;

      2. To employees, consultants, affiliates or other businesses or persons for the purpose of processing such information on our behalf. In such circumstances, we require that these parties agree to protect the confidentiality of such information and to comply in all respects with this Policy.

      3. To satisfy laws, such as the Electronic Communications Privacy Act, regulations, or governmental or legal requests for such information;

      4. To disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating our Terms of Use or other User policy;

      5. To operate the Site properly;

      6. To protect the Site and our Users;

      7. We will cooperate with law enforcement authorities, private-party litigants, and other seeking information about our Users to the extent required by applicable law. Examples of such cooperation include compliance with discovery requests, subpoenas, court orders, and writs.

      We may also share non-PII (such as anonymous User usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality of the Services.

  4. Commitment to Children’s Protection

    Our Site does not target and is not intended to attract children under the age of 13. We do not knowingly collect information from or about children under the age of 13. Child Online Privacy Protection Act.

  5. Users Outside the United States.

    If you are a User of the Sites who resides in a country other than the United States, your accessing or using the Site in any way constitutes your agreement that (a) we may process your Personal Data for the purposes identified in the Policy, and (b) your Personal Data may be transferred to and processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Data may be less stringent than the laws in your country. By providing your Personal Data, you consent to such transfer.

  6. California Residents.

    Residents of the State of California have the right to request a list of all third parties to which SM has disclosed certain information during the preceding year for the third parties' direct marketing purposes as stated in California Civil Code Section 1798.83.

    However, it is our policy to not disclose personal information. In the future if the Policy changes in this respect, you have given us your email address to contact you with any material changes, and you are a California resident and want such a list, please contact us at [email protected] with subject “California Privacy Rights”

  7. Your Choices.

    You can opt out of marketing emails or text messages by following the instructions in any marketing emails or text messages you receive. You can also opt-out by sending us an email. To request changes to or to review your information, please send us an email. You may also email us to have your personal information deleted.

    1. You can choose not to provide personal information. However if you don’t provide us with information some Site features may not work. You can also choose to configure browser not to accept cookies. If you do so, however, some parts of our Site may not work.

      You can control cookies and tracking tools. Your browser may give you the ability to control cookies or other tracking tools. How you do so depends on the type of tool. Certain browsers can be set to reject browser cookies. To control flash cookies, which we may use on certain websites from time to time, you can go here. Why? Because flash cookies cannot be controlled through your browser settings. If you block cookies on your browser, certain features on our Site may not work. If you block or delete cookies, not all of the tracking activities we have described here will stop. Choices you make are both browser and device-specific.       Our Do Not Track Policy. Some web browsers have a “Do Not Track” feature. This feature lets you tell websites you visit that you do not want to have your online activity tracked. These features are not yet uniform across browsers. Our Site is not currently set up to respond to those signals.

  8. Cookies Policy.

    A “cookie” is a small data file that can be placed on your hard drive when you visit certain websites. A “web beacon” is a small, transparent graphic image placed on a website, which allows the site to record the actions of a visitor opening the page that contains the beacon. SM uses cookies and may use web beacons to collect, store, and sometimes track information for statistical purposes to improve the Site performance and delivery.

    We use cookies and may use web beacons to save your settings and to provide customizable and personalized services to you. These cookies or web beacons do not enable third parties to access any of your customer information. Advertisers and partners may also use their own cookies. We do not control use of these cookies and expressly disclaim responsibility for information collected through them.

    Your browser may give you the ability to control cookies or other tracking tools. How you do so depends on the type of tool. Certain browsers can be set to reject browser cookies.   9. Online Advertisements.

    While SM does not currently feature online advertisements and it does not intend to in the future, SM may display online advertisements in the future. At such time, SM would not be responsible for use of information by third-party websites of which are not affiliated with SM.

  10. Security.

    We store your personal data on a secure server that is password protected and shielded from the outside world by a firewall. SM has also implemented and followed other appropriate technical measures to protect against the risks of unauthorized access to, erroneous disclosure of, and unlawful interception of Personal Data.

    BUT, the Internet is not 100% secure. While SM uses commercially reasonable physical, managerial and technical safeguards to preserve the integrity and security of your personal information, we cannot promise that your use of our Site and information you provide will be completely safe for all time and under all circumstances. We encourage you to use caution on the Internet.

  11. In the Event of Merger, Sale, or Bankruptcy.

    In the event that we are acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from users as part of such merger, acquisition, sale, or other chance of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally we may not be able to control how your personal information is treated, transferred, or used.

    Complaints will be resolved internally in accordance with our complaints procedures. If you live in the European Union or Switzerland and efforts to resolve the matter internally are unsatisfactory, the complaint may be submitted to the American Arbitration Association, which has been selected as the independent recourse mechanism to resolve complaints and disputes relating to treatment of data originating in the European Union or Switzerland under this policy.

    This Policy does not supersede the Terms of Use governing your use of the Site. Any conflict between the two shall be resolved in favor of the Terms of Use.
